We are committed to protecting children’s privacy. This Site isn’t intended for children under 13, and we don’t knowingly collect personally identifiable information from anyone under 13.


Use of the Content

Content on this Site is protected by U.S. and foreign copyright laws. Black Health TV lets you view the Content for your personal, noncommercial use only. Any specific rules for software or other items on the Site are part of these Terms.

BHTV can change or remove Content and features at its discretion without notice. All rights not specifically granted here belong to Black Health TV and its licensors.

Liability of Black Health TV and Its Licensors

Your use of the Black Health TV Site and its Content is at your own risk.

Information transmitted via the BHTV Site may go through systems beyond Black Health TV’s control. Therefore, BHTV isn’t liable for delays, failures, interruptions, or corruption of data related to using the Site.

The BHTV Site and Content are provided “as is.” To the fullest extent allowed by law, Black Health TV, its licensors, and suppliers disclaim all warranties, express or implied, including but not limited to warranties of merchantability, non-infringement of third parties’ rights, and fitness for a particular purpose.

Black Health TV, its licensors, and suppliers don’t guarantee:

  • The accuracy, reliability, completeness, or timeliness of the Content, software, links, or communications.
  • Compliance with government regulations for drug disclosures or software tool approvals related to Content.

Black Health TV, its licensors, suppliers, or any third parties mentioned on the Site will not be liable for any damages (including incidental, consequential, personal injury/wrongful death, lost profits, lost data, or business interruption) resulting from your use or inability to use the Site or Content. This applies regardless of legal theory, even if advised of such damages.

Our liability, and that of our licensors and suppliers, for actual damages you incur is limited to U.S. $1000. We are not liable for personal injury or death caused by your use or misuse of the Site, Content, or Public Areas (defined below). Any claims related to your use of the Site or Content must be filed within one (1) year of the event. Your remedies under these Terms are exclusive and limited to what’s specifically provided herein.


User Content and Submissions

Your personal information submitted to Black Health TV is covered by our Privacy Policy. If there’s a conflict between these Terms and the Privacy Policy, these Terms will govern.

The Site includes interactive areas like blogs, user reviews, and comments (“Public Areas”). Users can also upload content to our official social media presences (e.g., Facebook, Twitter, YouTube, Instagram – “Social Media Platforms”). You agree not to post, upload, or transmit any communications or “User Content” to Public Areas or Social Media Platforms that infringe on anyone’s rights.

By submitting User Content to Public Areas or Social Media Platforms, you agree to these Terms and any other relevant policies (like our Reviews Guidelines or Comments Guidelines). Black Health TV can remove User Content for any reason, including violations of these Terms or other policies.

Any submissions or User Content to Public Areas or Social Media Platforms are considered non-confidential for all purposes. Please note, Black Health TV isn’t responsible for the operation, terms of use, or policies of any Social Media Platform; you should review their terms and privacy policies.

If you email Black Health TV (including through “Contact Us”), you agree not to send communications or content that infringe on any party’s rights. Any business information, ideas, concepts, or inventions submitted via email are also considered non-confidential for all purposes.

By submitting User Content to Public Areas, Social Media Platforms, or emailing Black Health TV, you automatically grant (or guarantee that the owner has granted) Black Health TV a royalty-free, perpetual, irrevocable, worldwide, non-exclusive, fully sublicensable right and license to use, reproduce, modify, publish, edit, translate, distribute, perform, and publicly display such content in any media or format now known or later developed. Black Health TV can sublicense these rights. If you want to keep any business information, ideas, or inventions private, do not submit them to Public Areas, Social Media Platforms, or via email. While we try to respond to all emails, we can’t always do so.


User Submissions — Image, Video, Audio Files

You agree to only post or upload media (photos, videos, audio) to the BHTV Site or Social Media Platforms that you have the full rights to transmit and license, and which don’t violate any trademark, copyright, privacy, or other rights. This means no copyrighted celebrity photos or cartoon images unless you own the copyright.

To protect privacy, do not submit any media containing Personally Identifiable Information (like names, phone numbers, email addresses, or website URLs) of yourself or others. Uploading media of other people without their permission is strictly prohibited.

By uploading media, you warrant that you have permission from all persons appearing in your media to make this contribution and grant the rights described here. Never post a picture or video of someone else without their explicit permission.

It’s strictly prohibited to upload media that contains hate speech, abuse, offensive images or conduct, obscenity, pornography, sexually explicit material, or anything that could lead to civil or criminal liability, or conflict with these Terms or the Privacy Policy.

You agree not to upload any material containing software viruses or harmful computer code designed to interrupt, destroy, or limit the functionality of any software or this website.

By uploading media to the BHTV Site or a Social Media Platform:

  • You grant Black Health TV a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, fully sublicensable right and license to use, copy, display, reproduce, modify, publish, transmit, create derivative works from, and distribute the media and any material within it.
  • You certify that anyone pictured in the media (or their parent/guardian if a minor) authorizes Black Health TV to use, copy, display, reproduce, modify, publish, transmit, create derivative works from, and distribute the media.
  • You agree to indemnify Black Health TV and its affiliates, directors, officers, and employees, holding them harmless from any claims and expenses (including legal fees) arising from the media and/or your failure to comply with these Terms.

Black Health TV can review all media before submission and remove any media for any reason, at any time, at our sole discretion, without prior notice.


Passwords

Black Health TV provides tools for you to record and store information. You are responsible for taking reasonable steps to prevent unauthorized access to your BHTV passwords or accounts. You are solely responsible for:

  1. Controlling the dissemination and use of sign-in names, screen names, and passwords.
  2. Authorizing, monitoring, and controlling access to and use of your BHTV account and password.
  3. Promptly informing Black Health TV if you believe your account or password has been compromised or needs deactivation. Use the “Contact Us” links on the Site to email us.

You grant Black Health TV and all others involved in the Site’s operation the right to transmit, monitor, retrieve, store, and use your information for Site operation. Black Health TV is not responsible or liable for information you submit, or for your or third parties’ use or misuse of information transmitted or received through BHTV tools and services.


User Content Guidelines

If you use or post User Content on a Public Area (like blogs) or Social Media Platform, you are solely responsible for your communications, their consequences, and your reliance on any communications found there. Black Health TV and its licensors aren’t responsible for the consequences of communications in Public Areas or on Social Media Platforms.

If you feel threatened or believe someone is in danger, contact your local law enforcement immediately. If you think you have a medical emergency, call your doctor or 911 immediately.

By using Public Areas and Social Media Platforms, you agree that the following actions are a material breach of these Terms:

  • Using Public Areas or Social Media Platforms in violation of any local, state, national, or international laws.
  • Posting material that infringes on intellectual property, privacy, or publicity rights.
  • Posting material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any person or entity, as determined by Black Health TV.
  • Posting advertisements or business solicitations.
  • After receiving a warning, continuing to disrupt dialogue or posting off-topic comments (unless it’s a free-form discussion).
  • Posting chain letters or pyramid schemes.
  • Impersonating another person.
  • Distributing viruses or other harmful computer code.
  • Harvesting, scraping, or collecting information about others (including email addresses) without their permission for posting or viewing comments.
  • Allowing anyone else to use your identification for posting or viewing comments.
  • Posting the same note repeatedly or “spamming.”
  • Engaging in any conduct that restricts or inhibits others from using or enjoying the Public Area, Social Media Platform, or Site, or which, in BHTV’s judgment, exposes BHTV or its customers/suppliers to liability or detriment.

Black Health TV’s Rights (But Not Obligations)

Black Health TV reserves the right (but is not obligated) to do any or all of the following:

  • Record dialogue in public chat rooms.
  • Investigate allegations of non-conforming communications and, at its sole discretion, remove or request removal of communications.
  • Remove abusive, illegal, disruptive, or non-conforming communications.
  • Terminate a user’s access to any or all Public Areas and/or the BHTV Site for any breach of these Terms.
  • Monitor, edit, or disclose any communication in Public Areas or on a Social Media Platform.
  • Edit or delete any communications posted on the BHTV Site, regardless of whether they violate these standards.

Black Health TV or its licensors have no liability or responsibility for performing or not performing these activities.


Black Health TV may provide links to third-party websites. We may also select sites as priority responses to search terms and allow advertisers to respond with ads or sponsored content. Black Health TV does not recommend or endorse the content on any third-party websites. We are not responsible for the content of linked third-party sites, sites framed within the BHTV Site, third-party search results, or third-party advertisements. We make no representations about their content or accuracy. Your use of third-party websites is at your own risk and subject to their terms of use. Black Health TV does not endorse any product, service, or treatment advertised on the BHTV Site.


Indemnity

You agree to defend, indemnify, and hold Black Health TV, its officers, directors, employees, agents, licensors, and suppliers harmless from any claims, actions, demands, liabilities, and settlements (including reasonable legal and accounting fees) resulting from or alleged to result from: (a) your use of the Site, (b) any User Content you post or upload, (c) your use of or reliance on any User Content, or (d) your violation of these Terms and Conditions.


General

Black Health TV is based in the United States, with its main offices in New Orleans, LA. We make no claims that the Site or its Content are appropriate or can be downloaded outside the United States. If you access the Black Health TV Network from outside the United States, you do so at your own risk and are responsible for complying with your local laws.

The sections on Liability, User Submissions, User Submissions – image/video/audio files, Indemnity, Jurisdiction, and Complete Agreement will remain in effect even if this Agreement expires or is terminated.


Jurisdiction

You expressly agree that any dispute with Black Health TV, or relating to your use of the BHTV Site, must be resolved in the courts of the State of Louisiana. You further agree and consent to the personal jurisdiction of the courts of the State of Louisiana for any such dispute involving Black Health TV or its affiliates, employees, contractors, officers, directors, and content providers.

These Terms are governed by the substantive laws of the State of Louisiana, excluding its conflict of laws principles. If any provision of these Terms is found invalid by a competent court, the other provisions remain fully valid and enforceable. No waiver of any Term will be considered a further or continuing waiver of that term or any other term.


If you believe any materials on or from the Site infringe your copyright, you can request their removal by contacting Black Health TV’s copyright agent (listed below) and providing the following information:

  • Identification of the copyrighted work you believe is infringed (describe the work, include a copy or URL of an authorized version).
  • Identification of the infringing material and its location (describe the material, provide URL or other relevant info).
  • Your name, address, telephone number, and email address (if available).
  • A statement that you have a good faith belief the complained-of use is unauthorized by the copyright owner, its agent, or the law.
  • A statement that the information you provided is accurate, and “under penalty of perjury,” you are the copyright owner or authorized to act on their behalf.
  • A signature or electronic equivalent from the copyright holder or authorized representative.
